Material Facts (Section 2 of 4)
As referenced in the Sale of Land Act, a material fact is any fact that would be important to a potential purchaser and could influence them in deciding whether or not to purchase a property, or to purchase a property only at a certain price. By law, vendors are required to disclose all facts about the property they are selling, and make further disclosures for any new facts that become known throughout the selling process, until the property is sold.
Vendors should prepare the property for sale without taking any steps to hide any material facts.They must provide this information to the Sales Consultant by answering the below questions, and may also provide this information to their legal representative which can then be included in the Section 32 (vendors statement) if applicable.
